Q Which states have paid family leave?

Thirteen states + DC as of 2026: CA, NY, NJ, RI, WA, MA, CT, OR, CO, DE, MD, ME, MN, plus DC. The remaining 37 states rely on federal FMLA (unpaid) only. Several other states (VT, NH, VA) have voluntary opt-in programs that aren't mandatory.

California PFL pays 70-90% of average weekly wage (higher percentage for lower earners) for up to 8 weeks. Maximum weekly benefit in 2026 is $1,765 (CA EDD). Funded through SDI payroll tax of 1.3% with no wage cap (the wage cap was removed in 2024).

NY PFL pays 67% of average weekly wage up to 67% of the State Average Weekly Wage. 2026 maximum is $1,228.53/week for up to 12 weeks. Funded entirely by employee payroll deductions (~0.388% of wages, capped). Available for bonding, family care, or qualifying military events.

Q Can I take PFL and FMLA at the same time?

Yes — most state PFL programs run concurrently with FMLA. So a 12-week state PFL claim also exhausts your 12-week FMLA leave. Coordinate with HR to confirm coverage. Some employers offer additional paid parental leave on top of state PFL — these typically also run concurrently.

Q When does Maryland and Delaware paid family leave start?

Delaware Paid Leave benefits became available in 2026 (contributions started January 2025). Maryland's FAMLI program benefits begin July 2026 (contributions started October 2024). Both follow similar structures to other state PFML programs.
